An estate is everything a person owns at death, plus the debts they owe. The word is used in three different ways depending on context.

Probate Estate

The probate estate includes only assets that pass under the will or by intestacy. Assets in a living trust, retirement accounts with named beneficiaries, life insurance, payable-on-death accounts, and jointly held property all bypass probate.

Gross Estate for Tax Purposes

The gross estate (federal Form 706) includes everything the decedent owned or controlled, including life insurance proceeds and revocable trust assets. Most Arizona families fall well below the federal exemption, but high-net-worth estates need to plan for it.

Net Estate

The net estate is what remains after debts, taxes, administration costs, and statutory family allowances are paid. This is what beneficiaries actually receive.

Arizona Probate Claims

The estate is reduced by valid creditor claims handled under A.R.S. 14-3104 before distribution to heirs or devisees.
