Medical Power of Attorney

Estate Documents

A document naming someone to make healthcare decisions for you when you cannot speak for yourself.

A medical power of attorney (also called a healthcare power of attorney) names a trusted person as your healthcare agent. This person makes medical decisions for you when you cannot communicate or decide for yourself.

What Your Healthcare Agent Can Do

Your agent can consent to or refuse treatments and choose healthcare providers. They can access your medical records and make end-of-life care decisions. The scope depends on the language in your document. You can be as broad or specific as you wish.

How It Works With Your Healthcare Directive

Your healthcare directive states your specific wishes. For example, no artificial nutrition if the condition is terminal. Your medical power of attorney gives your agent authority for situations the directive does not cover. Together, they handle any medical scenario.

When the Authority Begins and Ends

In Arizona, your healthcare agent's authority begins when a physician certifies you cannot make healthcare decisions. The authority ends when you regain capacity or upon your death. You can revoke a medical power of attorney at any time while you have capacity. Choosing the right agent is a key decision in your estate plan.
