The Most Common Problem We Find

The trust was created but the assets were never moved into it. If your home, bank accounts, or investments are still in your personal name, your trust will not prevent probate. It does not matter how well the document was written. An unfunded trust offers no protection.

We review trusts created by any firm, not just our own. You do not need to start over to get the protection you were promised.

What Changes Over Time

Divorce, remarriage, new grandchildren, a move to Arizona from another state, or a significant change in your finances can all create gaps in a plan that was solid when it was first signed. Older trusts often lack clear provisions for incapacity, meaning your family may still need court involvement if you become unable to manage your own affairs.

Arizona estate law has also changed significantly over the years. Trusts drafted more than five years ago may be missing protections that are now standard practice, including updated probate thresholds and beneficiary safeguards.

We review your beneficiary designations across all accounts, check your powers of attorney and healthcare directives, and confirm that your plan complies with current Arizona law.
