A due-on-sale clause is a provision in a mortgage or deed of trust that lets the lender demand full repayment if the property changes hands. Federal law (the Garn-St. Germain Act) and Arizona law (A.R.S. 33-1571) restrict enforcement in specific transfer scenarios. For example, transferring a home into a living trust where the borrower remains a beneficiary, or a spouse or child inheriting a residence they will occupy, generally falls within the protected categories.
