A written advance directive that states your wishes about life-sustaining treatment if you have a terminal condition or are permanently unconscious.

A living will is a written statement of your wishes about life-sustaining medical treatment. It speaks for you when you cannot speak for yourself.

What a Living Will Covers

Most Arizona living wills address whether you want CPR, mechanical ventilation, artificial nutrition and hydration, and other life-prolonging measures if you have a terminal condition or are permanently unconscious. Some also address pain management and palliative care preferences.

Arizona Requirements

Arizona recognizes a living will signed and witnessed (or notarized) under A.R.S. 36-3261. The statute also provides a sample form. You can register your living will with the Arizona Secretary of State's Health Care Directives Registry so providers can find it quickly.

Living Will vs. Health Care POA

A living will documents your treatment wishes. A health care power of attorney names the person who will make decisions for you when the living will does not cover the situation. Most complete Arizona estate plans include both, plus a HIPAA authorization and (when appropriate) a POLST.
